- Introduction. These Text Program Terms & Conditions (these “Text Terms”) govern your participation in the text messaging program (the “Text Program”) offered by National Football Museum, Inc. dba Pro Football Hall of Fame (the “Company” or “We,” “Our,” or “Us”), By enrolling in, signing up for, or otherwise participating in the Text Program, you agree to be bound by these Text Terms, as well as the Company’s Terms and Conditions of Use and Privacy Policy, each of which is incorporated herein by reference. In the event of a conflict between these Text Terms and the Terms and Conditions of Use, these Text Terms control solely with respect to the Text Program.
- Opt In. By providing your mobile number and affirmatively opting in to the Text Program, you expressly consent to receive recurring automated marketing and informational text messages from the Company at the number provided. Text messages may be sent using an automatic telephone dialing system or other automated technology and may include SMS, MMS, and/or RCS messages containing alerts, updates, promotional offers, event information, and other communications relating to Our products, services, programs, and activities (collectively, “Texts”). Your consent to receive Texts is not a condition of any purchase. You represent and warrant that you are the current subscriber or customary user of the mobile number provided and that you are authorized to enroll that number in the Text Program. You agree to promptly notify Us if your mobile number changes, is reassigned, or is no longer under your control.
- Cost and Frequency. Message and data rates may apply. Message frequency may vary. You are solely responsible for any costs related to or associated with your receipt of Texts. Contact your wireless carrier for pricing details. To the maximum extent permitted by applicable law, you agree that Texts may be sent at any time of day.
- Collection and Use of Information. In connection with the Text Program, We may collect certain information, including, but not limited to, your phone number, your name, and consent records concerning the Text Program. We may use this information to perform various activities, including, but not limited to, (1) sending you updates, promotional offers, and other information via Texts; (2) responding to your inquiries and providing customer support; (3) monitoring and analyzing trends, usage, and activities related to the Text Program; and (4) improving Our services and developing new features for the Company. Any information We collect from you pursuant to the Text Program is subject to Our Privacy Policy.
- Opt Out. You may opt out of receiving Texts at any time by replying “STOP” to the short code provided in the Text that you no longer wish to receive. After doing so, you may receive an additional Text confirming your decision to opt out. You understand and agree that terms other than “STOP” may not be recognized as a cancellation request and the Company bears no responsibility for not processing an opt-out that uses a term other than “STOP.”
- Help. For help, assistance, or support with anything regarding Texts, these Text Terms, or the Text Program, text “HELP” to the short code provided in the Text about which you have questions
- DISCLAIMER OF WARRANTIES. We will not be liable for any delays or failure in the receipt of any Texts in connection with the Text Program. Delivery of Texts is subject to effective transmission from your wireless service provider and is outside of Our control.

NO INFORMATION MADE AVAILABLE BY OR ON BEHALF OF THE COMPANY SHALL CREATE ANY WARRANTY.
- LIMITATIONS OF LIABILITY. UNDER NO CIRCUMSTANCES SHALL THE COMPANY BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS, USE, MISUSE, OR INABILITY TO USE OR ACCESS THE TEXT PROGRAM, HOWEVER CAUSED, OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, VIRUS, LINE OR SYSTEM FAILURE, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR DEVICE DUE TO YOUR USE OF THE TEXT PROGRAM OR DUE TO YOU DOWNLOADING ANY CONTENT THROUGH IT OR ON ANY WEBSITE LINKED TO IT, INCLUDING, WITHOUT LIMITATION, WHETHER ANY CLAIM IS BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY SHALL APPLY HOWEVER DAMAGES ARISE, INCLUDING, WITHOUT LIMITATION, WHETHER SUCH DAMAGES ARE INCURRED BY THIRD PARTIES.
- Other General Terms. We may modify, suspend, or terminate the Text Program, or your participation in the Text Program, at any time and for any reason, without prior notice. We may update or revise these Text Terms from time to time. Any changes will be effective upon posting the revised Text Terms on Our website, unless otherwise stated. Your continued participation in the Text Program after the effective date of any changes constitutes your acceptance of the revised Text Terms. You represent and warrant that you have the legal capacity and authority to agree to these Text Terms. The Text Program is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 in connection with the Text Program. If We become aware that personal information has been collected from a child under 13, We will take appropriate steps to delete such information. If any provision of these Text Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
